Case Overview

On July 7, 2021 (the "Petition Date"), U.S. Tobacco Cooperative Inc. and certain of its affiliates (collectively, the "Debtors") each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Eastern District of North Carolina.  This website provides information about the Debtors' chapter 11 case.  The cases are pending before the Honorable Joseph N. Callaway and are being jointly administered for procedural purposes under case number 21-01511.

On March 14, 2022, the Debtors filed their Third Amended Plan of Reorganization (the “Plan”) and Third Amended Disclosure Statement (the “Disclosure Statement”).  The Plan and the Disclosure Statement set forth, among other things, the Debtors’ proposed treatment of all claims against, and interests in, the Debtors.  The Plan also includes a proposed settlement of the claims asserted against the Debtors in certain class action litigation commenced prior the Petition Date captioned Lewis et al. v. Flue-Cured Tobacco Cooperative Stabilization Corporation, Case Nos. 05-CVS-188 and 05-CVS-1938 (the “Lewis Litigation”).  At a hearing scheduled for June 22, 2022, the Debtors will request that the Bankruptcy Court: (i) confirm (approve) the Plan, including the proposed treatment of claims against and interests in the Debtors, and (ii) approve the settlement of the claims asserted in the Lewis Litigation.
