On October 31, 2011, MF Global Holdings Ltd. (“MFG Holdings”) and MF Global Finance USA Inc. (“MFG Finance”) filed voluntary petitions in the U.S. Bankruptcy Court for the Southern District of New York (the "Bankruptcy Court"), seeking relief under the provisions of chapter 11 of title 11 of the United States Code (the "Bankruptcy Code"). On December 19, 2011, MF Global Capital LLC (“MFG Capital”), MF Global Market Services LLC (“MFG Market”), and MF Global FX Clear LLC (“MFG FX Clear”), also filed voluntary petitions in the Bankruptcy Court seeking relief under chapter 11 of the Bankruptcy Code. Finally, on March 2, 2012, MF Global Holdings USA (“MFG Holdings USA" and, collectively with MFG Holdings, MFG Finance, MFG Capital, MFG Market, and MFG FX Clear, the "Debtors"), filed a voluntary petition in the Bankruptcy Court seeking relief under chapter 11 of the Bankruptcy Code.
On November 7, 2011, the United States Trustee appointed the statutory creditors' committee (the "Committee") in the Debtors' bankruptcy case pursuant to section 1102 of the Bankruptcy Code. The United States Trustee designated the following five members to the Committee: Wilmington Trust Company, JP Morgan Chase Bank, N.A., Bank of America, N.A., Elliot Management Corporation, and Caplin Systems Ltd. Subsequently, Elliot Management Corporation, Caplin Systems Ltd. and Bank of America, N.A. withdrew from the Committee. On July 2, the United States Trustee appointed J.E. Meuret Grain Co., Inc. to the Committee. Proskauer Rose LLP serves as counsel to the Committee. Irena M. Goldstein is the principal attorney responsible for this engagement. Pursuant to multiple orders of the Bankruptcy Court, Louis J. Freeh (the “Trustee”) was appointed as the chapter 11 trustee for all of the Debtors. The Trustee is represented by Morrison & Foerster LLP and Pepper Hamilton LLP.
