Case Overview

On May 19, 2019 (the "Petition Date"), HSP Liquidation, LLC (fka Hollander Sleep Products, LLC) and six of its subsidiaries (the "Debtors") filed a voluntary petition in the United States Bankruptcy Court for the Southern District of New York seeking relief under the provisions of Chapter 11 of the United States Bankruptcy Code. The Debtors continue to operate its business and manage its property as a debtors-in-possession. This website was created to assist the Debtors in providing access to information for creditors, as well as to solicit and receive comments from such creditors.

On November 15, 2024, the Bankruptcy Court filed a Final Decree Closing the Chapter 11 Cases Pursuant to Section 350(a) of the Bankruptcy Code, Bankruptcy Rule 3022, and Local Bankruptcy Rule 3022-1 [Docket No. 636]. All chapter 11 cases are closed.

Wind Down Trust

The Wind-Down Trust (the “Wind-Down Trust”) was formed pursuant to the Debtors’ Modified First Amended Joint Plan Pursuant to Chapter 11 of the Bankruptcy Code [Docket No. 346] filed with the United States Bankruptcy Court for the Southern District of New York in the Chapter 11 Cases of Hollander Sleep Products, LLC, et al., (the "Plan") to (a) liquidate and distribute the Wind-Down Trust Assets; (b) make  continuing  efforts  to  collect  and convert the Wind-Down Trust Assets to Cash; (c) hold the remaining Interests in Hollander Canada and the Interests in Dream II to allow the Plan Administrator to administer the winding down of its affairs, and (d) make timely distributions to the Trust’s beneficiaries.

The Wind Down Trust Agreement was entered into on September 13, 2019 by and among (i) Hollander  Sleep  Products,  LLC,  Dream  II  Holdings,  LLC, Hollander Home Fashions Holdings, LLC, Pacific Coast Feather, LLC, Hollander Sleep Products Kentucky, LLC, and Pacific Coast Feather Cushion, LLC (each a “Debtor” and, collectively, the “Debtors”), and (ii) Drivetrain, LLC, as trustee and administrator (the “Plan Administrator”).

The Plan contemplates, among other things, that the Trust is created for the benefit of Holders of General Unsecured Claims against the Debtors. On September 5, 2019, Bankruptcy Court entered its Findings of Fact, Conclusions of Law, and Order Confirming Debtors' Modified First Amended Joint Plan Pursuant to Chapter 11 of the Bankruptcy Code [Docket No. 356]. On September 13, 2019, the Effective Date of the Plan occurred [Docket No. 371], and the Wind-Down Trust Assets vested to the Trust.
